1. Company Information

This website is operated by TK Unicorn d.o.o., with a registered office at Preloge 14, 1000 Ljubljana, Slovenia, registered and operating under the laws of the Republic of Slovenia.

2. Scope of Service

We provide digital marketing services that are combined into different tiered packages (depending on the monthly ad spend), and other add-on services as described on the Pricing subpage of our website. Each service package includes a set list of deliverables clearly outlined before purchase.

You understand and accept that the services provided are standardized per package and delivered based on the scope defined at the time of purchase. Services are sold on a one-time or subscription basis depending on the package.

3. Ordering & Payments

To purchase a service, you must select a service package via our Pricing page, which will direct you to a Stripe checkout link for secure payment processing.

By submitting your payment details, you authorize us and Stripe to charge the full amount specified.

NO REFUNDS

All payments are non-refundable, including in cases of cancellation, dissatisfaction, delay, or non-usage of services. By purchasing a package, you acknowledge and accept this policy in full.

4. Service Delivery

After purchase, we will initiate service delivery as per the timeline and scope described in the selected package. You are required to cooperate fully and promptly provide all necessary information and access for us to deliver the services effectively.

Delays due to your inaction or incomplete onboarding information do not constitute a basis for refunds.

5. Client Responsibilities

You agree to:

• Provide accurate and complete information necessary for service delivery.
  
• Cooperate with our team during the onboarding and execution phases.
  
• Not engage in abusive or unlawful activity related to our services.
  

Failure to comply with these responsibilities may result in suspension or termination of services without refund.

6. Intellectual Property

All content, designs, deliverables, and materials created by us remain our intellectual property until full payment has been received. Upon payment, we grant you a non-exclusive, non-transferable license to use the deliverables for your internal business purposes.

You may not resell or redistribute the materials without our written consent.

7. Analytics & Usage Date

We may collect data on how our services are used, including engagement metrics and campaign performance. This data helps us optimize and improve our services and may be shared with third-party tools for analytics purposes.

8. Third-party Service

We use trusted third-party service providers such as Stripe, project management tools, email platforms, and analytics services. By using our services, you consent to your data being processed by these third parties as necessary for service delivery.

We do not control or assume liability for the practices of these third parties.

9. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of revenue, business, data, or reputation.

Our total liability under these Terms shall be limited to the amount paid by you for the service package giving rise to the claim.

10. Disclaimer

We provide our services on an “as is” and “as available” basis. We do not guarantee any specific results from our services and disclaim all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We reserve the right to terminate or suspend your access to services if you breach these Terms or fail to comply with any requirements outlined herein. No refund will be issued in such cases.

12. Indemnity

You agree to indemnify and hold harmless TK Unicorn d.o.o., its affiliates, officers, agents, and employees from any claims, damages, liabilities, and expenses arising from:

• Your misuse of our services;
  
• Your breach of these Terms;
  
• Your violation of applicable laws or rights of any third party.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia. You agree that any disputes arising out of or related to these Terms shall be exclusively resolved by the competent courts located in Slovenia.

14. Privacy

We respect your privacy. Any personal data you provide is processed in accordance with our Privacy Policy and applicable data protection legislation. We will only use your data to deliver our services, communicate with you, and comply with legal obligations.

15. Privacy Content

Any content or materials provided by you (e.g., logos, brand assets, website credentials) remain your intellectual property. However, by providing such content, you grant us a license to use, reproduce, and modify it for the purpose of delivering the agreed services.

You warrant that all provided content is owned or properly licensed by you and does not infringe third-party rights.

16. Duration of the Contract

Unless explicitly stated otherwise in a special offer or written contract between us, the contract for all monthly Services packages shall commence upon first monthly payment and shall continue, subject to the remaining terms of these Terms, until terminated by you giving us at least 3 days prior written notice.

Without affecting any other right or remedy available to us:

a) We may terminate our cooperation with you with immediate effect by giving written notice if you fail to pay any amount due under these Terms on the due date for payment and remain in default for 7 days after being notified in writing to make such payment; and

b) We reserve the right to suspend all Services until payment has been made in full or until our cooperation with you has been terminated under clause 16.2 (a).

17. Cancellation of an Individual Order

If you cancel an individual order at any time—particularly under an hourly service package—you will be charged for the time already spent on providing the services until the moment of cancellation. No refunds will be issued for this partial service.

18. Price of Service & Payment Terms

The price of the services will be the price indicated on the order page at the time of purchase.

All prices displayed on our website are exclusive of VAT or applicable sales tax, which will be charged in accordance with the relevant local regulations and only after a valid VAT or sales tax invoice has been issued.

• Prepayment – Our bank details are provided at checkout. Services begin once payment is confirmed.‍
• Credit & Debit Cards – We accept VISA, MASTERCARD, MAESTRO, AMERICAN EXPRESS, DISCOVER, JCB.
